Terms of Use

Article 1 – Parties

Seller/Service Provider: 4Unit Market, Itır Sk. Yunus Emre Sancaktepe 16, 34791 İstanbul

Buyer: The natural or legal person placing the order

This contract has been drawn up in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette dated 27.11.2014, No. 29188).

Article 2 – Subject Matter

The subject of this contract is the determination of the rights and obligations of the parties regarding the sale and delivery of food and beverages ordered by the buyer through the OwnTheOrder ordering platform.

OwnTheOrder is solely a technical ordering platform. The sales contract for food and beverages is concluded between the buyer and the respective restaurant. 4Unit Market (4Unit) is not a party to the sales contract.

Article 3 – Preliminary Information

In accordance with Article 5 of the Distance Contracts Regulation, the buyer has been informed about:

• Essential characteristics of products/services
• Sale price including VAT (KDV)
• Delivery costs (set by the restaurant)
• Payment method and plan
• Right of withdrawal (see Article 6)

Article 4 – Order and Contract Formation

The buyer's order on the platform constitutes an offer. The sales contract is formed when the restaurant accepts the order. The restaurant may reject orders due to unavailability, capacity constraints or delivery area restrictions.

Payment Methods

• Credit/debit card: Online payment via external payment service provider
• Iyzico: Secure payment infrastructure
• Cash payment: Directly to the restaurant upon delivery or pickup

Article 5 – Delivery Conditions

• Delivery time and method are determined by the restaurant
• Displayed delivery times are estimates
• The buyer must provide a correct delivery address and be reachable
• Each restaurant defines its own delivery area

Article 6 – Right of Withdrawal

Under Article 48 of Turkish Consumer Protection Law No. 6502 and Article 15 of the Distance Contracts Regulation, the right of withdrawal DOES NOT APPLY in the following cases:

• Goods that are perishable or have a short shelf life
• Goods whose protective packaging has been opened after delivery

Prepared food and beverages are perishable products and are excluded from the right of withdrawal.

Statutory warranty rights remain unaffected.

Article 7 – Pricing and Payment

• All prices include VAT (KDV)
• Food and beverage prices are set by the restaurant
• Delivery costs are shown separately
• Payment processing via external payment service provider (Iyzico etc.)

Article 8 – Force Majeure

In the event of force majeure (natural disasters, war, strike, pandemic, government orders), the parties are released from their contractual obligations.

Article 9 – Data Protection

For detailed information about the processing of personal data, please refer to our privacy policy under KVKK (Law No. 6698) at /privacy.

Article 10 – Usage Rules

Use is restricted to persons aged 18 and over. Prohibited: use of bots, abuse of discount codes, prank orders, false information, system attacks.

Article 11 – Dispute Resolution

Consumer Arbitration Committee

For consumer disputes below the statutory threshold, the competent Consumer Arbitration Committee (Tuketici Hakem Heyeti) has jurisdiction.

Consumer Court

For disputes above the threshold, the competent Consumer Court (Tuketici Mahkemesi) has jurisdiction.

Article 12 – Entry into Force

This contract enters into force upon the buyer's order confirmation.

Article 13 – Applicable Law

Turkish law applies, in particular the Turkish Code of Obligations and Consumer Protection Law No. 6502.
